1.1) The final photographic work includes all the images selected and edited by the photographer.

 

1.2) The photographer reserves the right to select images according to her aesthetic sense, and she cannot be held responsible for not delivering images that any individuals remember being taken and that may not appear in the final work.

 

1.3) The photographic work will be carried out with the technical means that the photography team deems appropriate. They can not be held responsible for the lack of results, for which we shall consider the risk inherent to the activity, as well as the weather conditions.

 

 

 

2.1 ) For booking purposes, a reservation fee (40% of the cost of the chosen services) must be paid. The remaining balance of 60% should be paid on the event day.

 

2.2) Once the date has been booked, the photographer will no longer provide her services for that same date.

 

 

 

3.1) The client may waive the agreed services up to two months after the first payment (reservation fee), with no refund.

 

3.2) The annulment or cancellation of the event by the client (less than or 6 months prior to  the date of the  event) will result in the payment of a 500€ compensation to the photographer. 

 

3.3.) In case of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of the reservation fee.

 

3.4) The photographer is responsible for finding another   photographer if she is unable to attend the event date due to circumstances beyond her reasonable control (e.g. sudden illness, injury, victim of crime, flooding etc.).

 

3.5) If it becomes necessary to postpone the event for reasons unrelated to any of the parties (e.g. epidemics, fires, earthquakes, terrorist attacks, etc.), one date change is contemplated without affecting the originally defined conditions, and must be subject to the availability of both parties.

 

3.6) If the postponement date is changed more than once, and moved 12 to 24 months after the original date, a postponement fee of €250 will be charged.

 

3.7) If the postponement date is set to a date the photographer cannot cover, there will be no refund of the reservation fee.

 

3.8) In case of postponement without a defined date and for an indefinite period, there will be no refund of the  reservation fee and the conditions defined on the date of the original contact will not be maintained.

 

 

4. WORK DELIVERY

 

4.1) The final work will be delivered to the clients by wetransfer (or similar system), in high resolution digital format JPG, with no watermark, within a period of 7 -10 days except for duly communicated exceptions. 

 

4.2) Delivery of the final work will be made only upon payment of the last installment of the agreed amount, in order to guarantee its delivery.

 

4.3) The photographer has the right not to deliver the final work, in case of non-compliance with payment by the client.

 

4.4) The original files (RAW files) of the selected final work will not be delivered and will be stored for a period of 3 years. 

 

 

 

5.1) In case of accidents / theft of photographic material or personal property of the photography team by third parties in event situations, the individuals responsible for such acts (or the client, in their absence) should be held liable.

 

5.2) The photographer is not responsible for situations in which she is the target of accidents and theft (caused by third parties) that cause irrecoverable damage to the equipment and photographic work.

 

 

 

6.1) The RAW and JPG files of all the images that make up the reportage are the property of Helena Tomás Photography, to whom the copyright also belongs.

 

6.2) The client allows the photographer to display any photographs included in the photographic work to generally promote her business in advertising, competitions, brochures, magazine articles, blogs, websites, sample albums etc. and the client also gives the photographer permission to be tagged on social media. If they do not authorize it, they must communicate it in writing, in advance.

 

6.3) The photographer will aim to keep the photographs safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than Helena Tomás Photography.
